Terms of Service

1 Acceptance of these Terms

By downloading, accessing, or using Stream, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Rize Labs LLC.

2 Description of the Service

Stream is a music discovery app that lets you explore songs through 30-second previews and personalize a feed based on artists and genres you choose. Previews and related metadata are provided through Apple’s iTunes Search API. Rize Labs does not host, own, or store the music itself. Stream also includes links to Apple Music, where you can listen to full tracks; some links participate in Apple’s affiliate program.

We may change, suspend, or discontinue any part of the Service at any time, including because a third-party service we rely on changes or becomes unavailable.

3 Eligibility

You must be at least 13 years old to use Stream. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using Stream, you represent that you meet these requirements and that the information you provide is accurate.

4 Your account

To use Stream, you create an account using your email address. You agree to:

• provide accurate and current information;
• keep your login credentials confidential and secure;
• be responsible for all activity that occurs under your account; and
• notify us promptly at support@streammusicapp.com if you suspect unauthorized use.

You may delete your account at any time from within the app. We may suspend or terminate accounts as described in the Termination section.

5 Stream+ subscriptions

Stream offers an optional paid subscription, “Stream+,” that unlocks additional features. The current plans, features, and prices are shown in the app at the point of purchase.

• Billing through Apple. Stream+ is sold as an in-app purchase and billed through your Apple App Store account. Payment is charged to your Apple ID when you confirm the purchase.
• Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Apple charges the renewal to your account within 24 hours before the period ends.
• Managing and canceling. You can manage or cancel your subscription in your Apple App Store account settings. Deleting the app does not cancel your subscription.
• Free trials. If a free trial is offered and you subscribe, any unused portion of the trial is forfeited when you purchase a subscription, where applicable.
• Refunds. Purchases are processed by Apple, and refunds are handled by Apple under its policies. We generally cannot issue refunds directly for App Store purchases.
• Price changes. We may change subscription prices. Changes apply to future billing periods, and where required, Apple will seek your consent to a price increase before it takes effect.

6 Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract source code, except where the law permits;
• access the Service or its underlying data through automated means, scraping, or bots, or otherwise misuse the iTunes Search API or affiliate links;
• interfere with, disrupt, or overload the Service or its supporting infrastructure;
• attempt to gain unauthorized access to any account, system, or data;
• infringe the intellectual property or other rights of Rize Labs or any third party; or
• remove, obscure, or alter any proprietary notices.

7 Intellectual property

The Stream application, including its software, design, branding, name, and original content, is owned by Rize Labs LLC and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Stream for your personal, non-commercial use, subject to these Terms.

Music and related content. All music previews, sound recordings, compositions, artwork, artist names, and metadata available through Stream belong to their respective rights holders, including artists, labels, publishers, and/or Apple, and are made available through Apple’s iTunes Search API. These Terms do not grant you any ownership of, or rights in, that content beyond listening to previews within the app for personal discovery. All rights not expressly granted are reserved by the applicable rights holders.

Feedback. If you send us suggestions or feedback, you grant us a non-exclusive, royalty-free, perpetual license to use it without obligation to you.

8 Third-party services

Stream depends on and links to third-party services, including Apple, the iTunes Search API, Apple Music, Supabase, and Resend. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services or content. Stream participates in Apple’s affiliate program, which means we may earn a commission when you follow certain links to Apple Music and make a purchase or subscribe. This does not change the price you pay.

9 Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any particular song, preview, or feature will be available, since availability depends on Apple’s iTunes Search API and other third-party services outside our control. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10 Limitation of liability

To the maximum extent permitted by law, Rize Labs LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising out of or related to your use of, or inability to use, the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) fifty U.S. dollars (US$50).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

11 Indemnification

You agree to indemnify and hold harmless Rize Labs LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12 Termination

You may stop using Stream and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if we are required to by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will survive.

13 Apple App Store & EULA terms

The following additional terms apply because you obtained Stream from the Apple App Store. In these terms, “Application” means Stream, and “Apple” means Apple Inc.

• Acknowledgment. These Terms are between you and Rize Labs LLC only, not with Apple. Rize Labs, not Apple, is solely responsible for the Application and its content.
• Scope of license. The license granted to you for the Application is a limited, non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. Rize Labs is solely responsible for providing any maintenance and support services for the Application. Apple has no obligation to furnish any maintenance and support services for the Application.
• Warranty. Rize Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
• Product claims. Rize Labs, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property rights. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Rize Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer name and address. Questions, complaints, or claims regarding the Application should be directed to: Rize Labs LLC, support@streammusicapp.com.
• Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using the Application.
• Third-party beneficiary. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14 Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to any applicable third-party terms (including Apple’s), you agree that any dispute not otherwise resolved will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws of your place of residence. If you have a concern, we encourage you to contact us first at support@streammusicapp.com so we can try to resolve it informally.

15 Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms here. If we make material changes, we will provide additional notice as appropriate. Your continued use of Stream after an update means you accept the revised Terms.

16 Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Rize Labs regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
